1. Agreement to terms

These terms and conditions ("Terms") govern your use of the meow meow scratch platform ("Platform"), including the website, API services, and iOS application, operated by meow meow scratch ("we", "us", "our") from Australia.

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility

The Platform is designed as an educational tool for learners of all ages. If you are under 18, you should have permission from a parent or guardian before creating an account. Parents and guardians are responsible for supervising the use of the Platform by minors in their care.

3. Accounts

You are responsible for maintaining the security of your account credentials, including your password and API keys. You must not share your account with others or allow unauthorised access. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for malicious purposes.

4. Acceptable use

You agree not to use the Platform to:

• Violate any applicable law or regulation, including Australian Commonwealth and state laws
• Store, transmit, or distribute malware, viruses, or other harmful code
• Attempt to gain unauthorised access to the Platform, other accounts, or connected systems
• Abuse API rate limits or deliberately overload the Platform
• Store content that is illegal, defamatory, or infringes on the intellectual property rights of others
• Use the Platform to scrape, harvest, or collect data from third parties without their consent
• Impersonate another person or misrepresent your affiliation with any entity

5. User-created content

You retain ownership of the apps, endpoints, records, and other content you create on the Platform ("Your Content"). By using the Platform, you grant us a limited licence to host, store, and transmit Your Content solely for the purpose of operating the Platform and providing services to you.

You are solely responsible for Your Content. We do not monitor or review user-created content, but we reserve the right to remove content that violates these Terms.

6. API usage and keys

API keys are provided for your use in connecting hardware, software, and other services to the Platform. You are responsible for keeping your API keys secure. Do not embed API keys in publicly accessible code or share them with untrusted parties.

We may impose rate limits and usage quotas. Exceeding these limits may result in temporary or permanent restriction of access.

7. Proxy endpoints

The Platform allows you to create proxy endpoints that forward requests to external APIs. You are solely responsible for ensuring you have the right to access any external service you configure as a proxy target. We are not responsible for the content, availability, or terms of service of any third-party API.

8. Subscriptions and billing

Some features of the Platform require a paid subscription. Subscriptions are billed through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods unless required by Australian Consumer Law.
• We may change subscription pricing with reasonable notice. Price changes take effect at your next billing cycle.

9. Chatbot and AI features

The Platform may include chatbot or AI agent features powered by third-party providers (OpenAI, xAI, or local models). Content you submit to these features may be processed by the relevant provider. AI-generated responses are provided "as is" and we make no guarantees about their accuracy, completeness, or suitability for any purpose.

10. Intellectual property

The meow meow scratch name, logo, website design, and platform code are our intellectual property. You may not copy, modify, distribute, or reverse-engineer the Platform or any part of it without our prior written consent.

11. Availability and warranties

The Platform is provided on an "as is" and "as available" basis. We do not guarantee that the Platform will be uninterrupted, error-free, or available at all times. We may perform maintenance, updates, or changes that temporarily affect availability.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by Australian law, our total liability to you for any claims arising from or related to your use of the Platform is limited to the amount you have paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Account termination

You may delete your account at any time. Upon deletion, all your data — including apps, endpoints, records, and API keys — will be permanently removed. We may also terminate or suspend your account for violations of these Terms, with or without notice.

15. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of Australia. Any disputes arising from or related to these Terms or the Platform will be subject to the exclusive jurisdiction of the courts of Australia.
